Terms & Conditions

1. ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "User") and DB AI Technology Sdn. Bhd. ("DB AI Technology", "we", "us", or "our"), including its Roamin brand and related Travel eSIM products and services (collectively referred to as "Services"), governing your access to and use of our mobile application, website, eSIM-related products, services, features, technologies, and any associated software or platforms.

By accessing, registering, installing, downloading, or otherwise using our Services in any manner, you acknowledge that you have read, understood, and agreed to comply with these Terms. If you do not agree to any part of these Terms, you must immediately cease all access and use of our Services.

These Terms are applicable to the following categories of users:

  • Individual Users – Private consumers utilizing DB AI Technology’s Roamin Travel eSIM Services for personal, non-commercial purposes.

  • End Recipients – Persons who benefit from Services provided to them via a third-party purchaser, including but not limited to corporate clients or intermediaries.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case the terms “you” or “your” shall refer to such entity.

2. SCOPE OF SERVICES

DB AI Technology, through its Roamin Travel eSIM platform, offers a digital connectivity solution that enables users to purchase and activate embedded SIM (eSIM) profiles on supported devices. Through our Services, users can:

  • Purchase local and international data plans;

  • Download and activate eSIMs on compatible devices;

  • Manage active eSIMs through our application;

  • Access customer support and self-service tools.

We reserve the right to modify, suspend, or terminate any portion of our Services, and to restrict access to certain features based on user category or geographic location.

To utilize the Services, you must submit accurate information including but not limited to e-mail address as prompted. 

3. DEVICE COMPATIBILITY

You are solely responsible for ensuring that your device is compatible with our Services. This includes verifying that your device:

  • Supports eSIM functionality;

  • Is unlocked from any mobile network carrier;

  • Complies with applicable regulations of your local jurisdiction.

We provide a list of known compatible devices through our support documentation, but this list is not exhaustive. Newly released or region-specific models may not be supported.

4. CONTRACT COMMENCEMENT AND TERMINATION

Your contract with DB AI Technology shall commence upon confirmation of a successful order placement, and shall remain in effect unless terminated under the conditions described herein.

Termination may occur:

  • Upon deactivation or deletion of your eSIM;

  • If no active plan remains associated with your account;

  • By written notice from either party;

  • If DB AI Technology reasonably believes you have violated these Terms.

Corporate agreements may include additional terms and obligations governed by a separate written agreement.

 

5. FEES, PAYMENTS AND TAXES

All prices for Services are presented in Malaysian Ringgit (MYR). Payment is accepted via secure third-party processors, including credit/debit cards, digital wallets, and online payment gateways. You may be required to accept third-party terms to complete your transaction.

Fees are exclusive of applicable taxes, duties, levies, and service charges where applicable. These additional charges will be itemized at checkout and calculated based on your billing location.

 

6. DELIVERY AND ACTIVATION

Upon successful purchase, your Roamin Travel eSIM will be delivered digitally in-app or via e-mail, and important updates (such as post-activation confirmation and low-usage alerts) may also be sent via WhatsApp to your registered number. Activation must occur within the stipulated timeframe provided during purchase.

DB AI Technology shall not be held responsible for failures resulting from delays in activation, device incompatibility, or user error.

 

7. REFUND, CANCELLATION & MODIFICATION

Refunds are issued solely at the discretion of DB AI Technology for Roamin Travel eSIM Services and only when service disruptions are caused by our error or failure. Refund eligibility is subject to the following conditions:

  • Requests must be submitted within thirty (30) days from the date of purchase;

  • eSIMs that have been installed or activated are not eligible for refund unless found defective;

  • Refunds are not applicable for accidental purchases or incompatibility with user devices.

Refunds, if approved, may be processed via the original payment method. You may be requested to provide additional supporting details during the refund process. 

We reserve the right to refuse refunds in the event of fraud, misuse, or breach of these Terms. DB AI Technology may impose a reasonable administrative fee for processing approved refunds.

 

8. USER OBLIGATIONS

You agree not to engage in the following activities:

  • Misuse or abuse of our Services in any unlawful or fraudulent manner;

  • Breach or bypass of security protocols;

  • Transmission of harmful or malicious software;

  • Misrepresentation of identity or affiliation;

  • Use of Services in a way that may disrupt, impair, or interfere with our infrastructure or third-party networks.

Violation of these obligations may result in account suspension or legal action.

 

9. DATA PRIVACY AND SECURITY

DB AI Technology is committed to protecting your personal data in compliance with the Malaysian Personal Data Protection Act 2010 (PDPA). Our Privacy Policy outlines how your data is collected, used, stored, and shared. By using our Services, you consent to our data practices as described therein.

 

10. PRICING AND PROMOTIONS

All prices stated for DB AI Technology’s Roamin eSIM packages and related services reflect the current retail rates. We may, from time to time, offer promotional rates or discounts for a limited duration, which are subject to specific conditions and eligibility requirements that will be clearly communicated during the promotional period. Upon conclusion of any promotion, standard pricing will automatically apply unless otherwise specified.

DB AI Technology reserves the right to adjust pricing or promotional structures at any time and without prior notice. These changes may be based on multiple factors, including but not limited to market fluctuations, currency exchange rates, service costs, or strategic revisions.

Prices may differ between user categories. These distinctions are based on the scope of use, volume commitments, and unique service customizations that may apply.

We aim to communicate any significant pricing changes in a timely manner through our platforms or directly via email. However, due to dynamic market conditions, prior notice may not always be feasible.

For Individual Users: Pricing information is available on our website and within the app. Users are encouraged to regularly check these platforms to remain informed.

DB AI Technology reserves the right to cancel promotions suspected of misuse, including but not limited to fraudulent registrations or multiple redemptions by the same user. We also reserve the right to revise, suspend, or terminate any promotional campaign at our sole discretion and without advance notice.

 

11. LOCAL REGULATORY COMPLIANCE

You are required to comply with all applicable laws and telecommunications regulations in any country where DB AI Technology’s Roamin Services are used. This includes but is not limited to obligations related to SIM or eSIM activation, real-name identity verification, and the registration of telecommunications equipment.

Where required by law, DB AI Technology may, with your consent, submit relevant identification or technical information (such as personal ID or device details) to national authorities to facilitate compliance. Your acceptance of these Terms includes consent for us to use your information solely for the purpose of meeting such regulatory obligations, in line with applicable data protection laws.

 

11.1 Hong Kong and Taiwan

In regions such as Hong Kong and Taiwan, it is mandatory to complete real-name registration before using eSIM services. You must provide accurate and verifiable identification documentation during purchase or activation if required by the local government or telecommunications authority.

DB AI Technology may collect and submit this information to comply with national requirements. Services may be suspended, delayed, or denied if you do not complete this process or provide inaccurate or fraudulent data. Failure to comply may also expose you to legal consequences under local laws.

Please ensure you review and adhere to any local compliance steps presented during eSIM activation for the relevant country.

 

12. FAIR USAGE POLICY

DB AI Technology aims to provide reliable and equitable connectivity services through its Roamin Travel eSIM plans to all users. To prevent misuse, certain data plans may be subject to fair usage limits as determined by DB AI Technology or its network providers. These limits ensure network quality and availability across all users.

If usage exceeds purchased limits or individual consumption or violates the intended purpose of the plan, DB AI Technology reserves the right to take corrective actions. These may include reducing data speed, suspending service, or terminating the plan with or without prior notice.

Users must refrain from engaging in activities that artificially inflate traffic or misuse the Service, such as automated downloads, reselling of bandwidth, or tethering beyond reasonable limits.

 

13. SERVICE AVAILABILITY

While DB AI Technology strives to offer continuous and reliable connectivity via Roamin, our Services rely on third-party telecommunications networks and systems. As such, availability may vary by region, device, or carrier partner.

DB AI Technology does not guarantee uninterrupted service, and shall not be held liable for outages, latency, or performance issues caused by network failures, maintenance, or unforeseen technical circumstances beyond our control.

Users acknowledge that service access may also be affected by device compatibility, software configuration, and compliance with local regulations.

 

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless DB AI Technology, its officers, directors, employees, affiliates, and agents from and against any claims, demands, liabilities, losses, damages, or expenses (including legal fees) arising out of or related to:

  • Your breach of these Terms;

  • Your violation of any applicable law or third-party rights;

  • Any misuse of the Services or unlawful activity conducted through your account;

  • Inaccurate, misleading, or unlawful data submitted by you.

This indemnity obligation will survive termination of your use of the Services.

 

15. LIMITATION OF LIABILITY

To the fullest extent permitted by Malaysian law, DB AI Technology disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.

In no event shall DB AI Technology be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to:

  • Use or inability to use the Services;

  • Errors or interruptions in service;

  • Loss of data or business opportunities;

  • Unauthorized access to your account or personal information.

Our maximum aggregate liability shall be limited to the amount paid by you for the Services.

 

16. GOVERNING LAW AND DISPUTES

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes or claims arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

 

17. DISPUTE RESOLUTION AND ARBITRATION

In the event of any dispute, controversy, or claim arising out of or in connection with these Terms or the use of the Services, the parties shall first seek to resolve the matter amicably through good-faith negotiations.

If a resolution cannot be reached within thirty (30) days, the dispute shall be referred to and finally resolved by arbitration administered by the Asian International Arbitration Centre (AIAC) in accordance with the AIAC Arbitration Rules. The seat of arbitration shall be Kuala Lumpur, Malaysia. The arbitration shall be conducted in the English language before a sole arbitrator.

The decision of the arbitrator shall be final and binding on both parties. Each party shall bear its own costs and expenses in connection with the arbitration unless otherwise determined by the arbitrator.

Nothing in this section shall prevent either party from seeking interim or injunctive relief from a court of competent jurisdiction in Malaysia where necessary to preserve rights or prevent irreparable harm.

 

18. MODIFICATIONS TO TERMS

DB AI Technology reserves the right to modify, update, or revise these Terms at any time. Any material changes will be communicated via email or platform notification. Your continued use of the Services following such changes constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically.
